General Terms and Conditions of Sale (T&Cs) – Hôtel Perpetual Paris
Article 1: Purpose of these T&Cs
These General Terms and Conditions of Sale (T&Cs) govern all reservations made with Hôtel Perpetual Paris, located in Paris, France. They define the rights and obligations of the parties in the context of hotel room bookings and associated services. Any reservation made implies the full and unreserved acceptance of these T&Cs.
Article 2: Pre-contractual Information (In accordance with Article L.221-5 of the Consumer Code)
In accordance with the provisions of Article L.221-5 of the Consumer Code, the customer is informed before concluding the contract of the main characteristics of the services provided, the total price of the reserved services, and the payment and execution terms.
2.1. Dispute Resolution Method
In the event of a dispute concerning the service provided, the customer is informed that they may contact a consumer mediator free of charge. In accordance with Articles L.616-1 and following of the Consumer Code, the hotel provides a mediator to customers to attempt to resolve any disputes amicably. 2.2. Right of Withdrawal
In accordance with Article L.221-28 of the Consumer Code, hotel room booking services, when provided for a specific date or period, are not subject to the right of withdrawal. Therefore, the customer is informed that they do not benefit from a withdrawal period to cancel a firm reservation. However, cancellation conditions may apply according to the terms defined at the time of booking.
2.3. Pricing
The applicable rates are those indicated at the time of booking, in euros, all taxes included (TTC). Prices include the applicable tourist tax but do not include breakfast unless explicitly mentioned in the offer. The breakfast price is €15 per person for the "Paris Time" breakfast and €21 per person for the "French Morning" breakfast, to be added to the room rate if not included in the selected offer.
2.4. Telephone Solicitation Opposition List
In accordance with Article L.223-2 of the Consumer Code, the customer has the right to register on the telephone solicitation opposition list (BLOCTEL), accessible at the following address: https://www.bloctel.gouv.fr.
Article 3: Online Dispute Resolution Platform
In accordance with Article L.616-2 of the Consumer Code, the customer has the option of using the European Online Dispute Resolution (ODR) platform for any complaints related to an online reservation. This platform is available at the following address: https://ec.europa.eu/consumers/odr/.
Article 4: Reservation and Payment Terms
4.1. Reservation
Reservations can be made through the hotel's website, by phone, or in person. Reservations become firm and final upon receipt of the hotel’s confirmation via email. The hotel reserves the right to refuse a reservation if payment has not been made according to the agreed terms.
4.2. Payment
Reservation payments can be made by credit card, bank transfer, or any other means indicated at the time of booking. A deposit or full payment may be required depending on the pricing conditions specified at the time of booking. In the event of non-payment, the hotel reserves the right to cancel the reservation without notice.
Article 5: Cancellation and Modification Terms
5.1. Cancellation by the Customer
The cancellation conditions are specified at the time of booking and may vary depending on the specific rates and offers chosen. In the absence of specific conditions, cancellations made less than 24 hours before the scheduled arrival date will incur fees equivalent to one night’s stay.
5.2. Modification of the Reservation
Any modification to the reservation must be approved by the hotel. Modifications are possible subject to availability and may incur additional fees.
Article 6: Hotel Liability
6.1. General Liability
Hôtel Perpetual Paris commits to providing the services described on its website and at the time of booking, subject to availability. However, the hotel cannot be held responsible for non-performance or poor performance of the reservation due to an act attributable to the customer, a force majeure event, or a third party.
6.2. Unfair Terms
In accordance with Articles L.212-1 and R.212-1 of the Consumer Code, any clause whose object or effect is to create a significant imbalance to the detriment of the consumer is deemed unwritten. The hotel may not include exoneration or limitation of liability clauses in the event of damages caused by its own failures or negligence. Any clause excessively limiting the consumer's rights would be considered abusive and unenforceable.
Article 7: Force Majeure
In the event of force majeure (unpredictable, irresistible events beyond the parties' control, such as natural disasters, pandemics, strikes...), the hotel reserves the right to cancel or modify the reservation without the customer being entitled to any compensation. Payments made may be refunded or rescheduled according to the hotel’s policies.
Article 8: Personal Data
The personal data collected during the reservation process is necessary for the management of the booking and the smooth running of the stay. It may also be used for commercial prospecting purposes, unless the customer explicitly objects. In accordance with the Data Protection Act, the customer has the right to access, rectify, oppose, and delete their personal data, which can be exercised by contacting the hotel at the following address: contact@perpetual.paris.
Article 9: Applicable Law and Competent Jurisdiction
These T&Cs are governed by French law. In the event of a dispute and after the failure of any attempt at amicable resolution, the customer may take the matter to the competent court in accordance with the jurisdiction rules laid down in the Code of Civil Procedure. The customer may choose between the jurisdiction of their place of residence or that of the location where the service was provided, in accordance with Article R.631-3 of the Consumer Code.
Article 10: Modification of the T&Cs
Hôtel Perpetual Paris reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in force at the date the customer made their reservation.
